Legal regulation

The legislation is addressed in Act No.231/2019 Coll. on the execution of detention and on amendment and supplementation of certain acts. It is an Act amending Act No. 576/2004 Coll. on health care, services related to the provision of health care and on amending and supplementing certain acts, as amended, and amending and supplementing certain acts – expected to come into force on 1 December 2022.

§ 81 sect. 4 of the Criminal Code – effective text

The court may, on the basis of an expert medical opinion, also decide to place the offender in a detention facility if the offender, whose stay at liberty is dangerous, is undergoing protective treatment in an inpatient health care facility and his/her behaviour endangers the life or health of other persons; the court shall decide on the proposal of the inpatient health care facility.

Guarding and security in the detention centre shall be provided by the Prison and Judicial Guard Corps.
